Pynn-Butler trial: Crime scene photos, witness testimony entered

The Supreme Court jury in the second-degree murder case in the fatal shooting of Nick Winsor heard testimony from witnesses who were at the scene minutes after the shooting.

The Supreme Court jury in the second-degree murder case in the fatal shooting of Nick Winsor heard testimony from witnesses who were at the scene minutes after the shooting.

Crime scene photos were also entered on Friday in the case against Philip Pynn and Lyndon Butler, who are being tried together in Winsor's death.

Winsor, 20, was shot and killed in an alleged robbery gone wrong in 2011. The Crown says the three men tried to rob Tom "Billy" Power, when Winsor was shot.

Pynn and Butler are also charged with the attempted murder of Power, assault with a weapon, assault causing bodily harm and possession of a dangerous weapon.

Melanie Fioratos and Joshua Brushett were driving along Portugal Cove Road around 10:30 p.m. on July 9, 2011, when they saw a man — who turned out to be Power — run into the middle of the road waving his arms.

Fioratos, who took the stand on Thursday, said she was apprehensive to stop for the man, saying he was "not someone I wanted to associate with," pointing out Power's tattoos and heavy jewelery.

She also said Power appeared to have blood on his neck, and had said he was beaten up.

Brushett, the driver, said he saw Power limping before collapsing, and stopped the car. He said Power asked to borrow Brushett's cellphone to call his girlfriend. There was no mention of a shooting. Brushett said he insisted on calling 911 but he said Power told him there was no need.

However, Brushett called 911 anyway, and said Power ran off once the phone call was made.

Police photos entered

The Supreme Court jury also saw police photos from Power's garage, where Winsor died from a fatal gunshot wound.

The Royal Newfoundland Constabulary photographed items in the garage once they arrived on the scene, including blood splatter, shoe prints left in blood inside the garage, and a cigarette butt.

Friday saw the closing of the first week of the trial against Pynn and Butler.

The case is expected to last another seven weeks, and will resume on Monday.
