Victoria man Daniel Blake Penney, who attempted suicide last week, has been charged with the second-degree murder of his estranged wife Mary Caitlin Walton.

Penney, 51, made a brief court appearance Tuesday morning and has been held in custody.

The body of Walton was found in a Queens Avenue duplex on Friday, just hours after Penney was discovered unconscious in the garage of a home the couple owned in Colwood, B.C.

Penney had been under a court order to stay away from Walton. It also banned him from being in the home, but he was allowed to continue to use the attached garage for his small mechanics business.
