A Superior Court judge granted the defence request for bail for Mustafa Ururyar, who was convicted last month of forcing Mandi Gray to perform oral sex and engage in sexual intercourse back on Jan. 31, 2015.
Days after his conviction, Justice Marvin Zuker revoked Ururyar's bail ahead of sentencing on September 14.
"This man raped Mandi Gray. Why should he not come into custody today?" Zuker said in revoking Ururyar's bail. "He's not the victim here."
Ururyar's defence team has filed an appeal of his conviction.
On Wednesday, defence lawyer Lisa Bristow confirmed to CBC News that the appeal judge, Ontario Superior Court Justice Michael Quigley, released Ururyar from jail and would be issuing his reasoning at a later date.
