Whitehorse condo owners fight apartment complex
Ask court for injunction to stop work on neighbouring development
Whitehorse condominium owners are in Yukon Supreme Court today hoping to stop work on a neighbouring apartment complex.
They say the developers have no right to build the multi-family units in Falcon Ridge without permission from the condo owners.
"They decided to proceed with building an apartment building that none of us wanted and we understand will be a mess to try and manage but they have not addressed any of our concerns or been honest with us or very open to co-operation, so if they don't want to play ball they are going to deal with it in court," said condo owner Grant Zazula.
The condo owners say the high density apartment building will obstruct views from their single family homes and decrease property values.
Their lawyer, Jim Tucker, is seeking a court order to stop construction immediately.
"If they don't get all the consents of the condo owners, then the property can't be used for apartment buildings," he said.
The developers have partially completed two of three floors in the neighbouring apartment complex.
An emergency hearing of the case is scheduled for later today in Yukon Supreme Court.
