A St. John's firefighter who had been facing two charges related to alleged sexual conduct with a teenage girl will not face a trial after prosecutors called no evidence.

Ronald Pomeroy, a captain with the St. John's regional fire department, is in his early 50s, and had been accused of sexual assault and sexual exploitation.

But a judge dismissed both charges against him in provincial court on Monday.

The offences are alleged to have occurred in St. John's between February and May 2023. Prosecutor Tim O'Brien said in a statement the Crown's decision "does not reflect the evidence gathered by the police or the credibility of the complainant."

"The evidence suggests that the factual underpinnings of the allegations were accurate and that a relationship between Mr. Pomeroy and the complainant did exist as described by her," O'Brien wrote.

"Unfortunately, these facts do not support the legal criteria required for a conviction in this matter."

Pomeroy received a Firefighter of the Year Award in 2019. A spokesperson with the City of St. John's confirmed Monday that he remains a member of the fire department.
