'Communication issues' delay Philip Pynn's court appearance in HMP riot case

Philip Pynn's court appearance was delayed Tuesday due to what Pynn's lawyer Mark Gruchy is calling communication issues.

"It's been difficult to reach him for purposes of co-ordinating this latest matter down here," said Gruchy.

Pynn is currently serving four years for the shooting and murder of Nick Winsor at the Atlantic Institution, a maximum security correctional facility in New Brunswick.

He was scheduled to appear for his alleged involvement in the 2014 riot at Her Majesty's Penitentiary and attack on Kenny Green.

Pynn is the last of the accused HMP rioters to have his case dealt with.

He was not present in court.

"Our intent will be to resolve that matter by way of a plea and disposition. The only thing which has been standing in the way is logistics," says Gruchy.

His next appearance been set over to Sept. 18 when Gruchy expects Pynn will be able to appear in court by video.

"I expect the matter to be resolved pretty quickly with respect to communication hopefully in a few days and we'll get moving."
