Grayson Delong, accused in Annex shooting, to appear in Toronto court Thursday

The man accused of shooting a criminal defence lawyer in the Annex yesterday will appear in a Toronto court on Thursday morning.

Grayson Delong was scheduled to make a court appearance around 4:15 p.m. However, he remains in hospital today.

Delong, who was being watched by a team of Halton Regional Police officers according to police sources, was shot by officers moments after he allegedly opened fire as the lawyer left his Bedford Road office.

Criminal defence lawyer J. Randall Barrs was shot in the legs. Barrs has been released from hospital and is said to be recovering well. 

Delong also suffered serious injuries during the incident. Witnesses told CBC News the suspect was attempting to flee the scene in a silver Honda Civic before police opened fire and used at least one SUV to box him in.

Delong, 42, is expected to face multiple charges in connection with the incident, including attempted murder, disguising himself with the intent of committing a crime and using a firearm according to court documents.

Ontario's Special Investigations Unit (SIU), which investigates any incident involving a police officer that results in death or serious injury, is looking into the shooting. 

There is some discrepancy about Delong's age. The SIU reports the man who was shot by police is 51. 

'It was like watching a TV show,' witness says

Peter Schilling, who saw the shooting from his second-floor office on Tuesday afternoon, said he was on the phone with a colleague staring out the window when he saw J. Randall Barrs get out of his car in the driveway of his law office.

A silver Honda Civic then screeched to a stop at the end of the driveway around 3:30 p.m. and a man stepped out, Schilling said.

"He got out of the car and fired four to five shots and (Barrs) hit the ground right away, all lower body hits — and lots of blood, as you can see now," Schilling said from his office, where he works as a surgical consultant.

A large blood stain remained Wednesday, leading from the end of the driveway to the front of the law office.

"It was just absolutely horrific and as loud as you think it would be," Schilling said. "It was like watching a TV show."

Seconds after the shots rang out, Schilling said he saw a man he believed to be an undercover officer sprint toward the scene, draw his weapon and begin firing at the gunman, who was wearing a reflective construction vest and hard hat.

The man tried to get away in the car, Schilling said, but was boxed in by unmarked SUVs.
