Lawyer Duane Rhyno sees all sex-crime charges dropped

Crown says new evidence emerged and there is no longer 'a realistic prospect of conviction'
All charges against a Lower Sackville lawyer who had been accused of human trafficking and sex crimes have now been dropped, after the remaining three were thrown out today in a Kentville courtroom.
Charges of sexual assault and two counts of procurement laid against Duane Rhyno were dismissed after the Crown received information this week that gave it no choice but to drop the case.
"The Crown constantly does reassessment of a case to see if there is a realistic prospect of conviction," said Crown prosecutor Dan Rideout. "In this case new information came to light and after reassessing we no longer have a realistic prospect of conviction."
Rhyno was charged with a series of offences in September 2014. Those included accusations of human trafficking, aiding and abetting prostitution and living off the avails of prostitution, charges that were dismissed last year.
Crown thought it had a case
Rideout said he couldn't elaborate on the evidence that led the Crown to drop the case.
"I can tell you that up until very recently, as of two days ago, it was felt by the Crown that there was a realistic prospect of conviction in this case," said Rideout. "It's not as if the Crown proceeds with charges when we don't feel that's the case."
Defence lawyer Craig Garson would not comment as he left the courtroom. Rhyno did not appear in court.
The charges involved a woman who was 26 at the time Rhyno was arrested. Her name throughout the court process was protected by a publication ban.
After the original charges were laid, Rhyno had to briefly give up practising law when his licence was suspended. He was allowed to return to practice, with conditions, in October 2014.
He also had to surrender his passport and give police advance notice of any travel plans he had.
A seven-day trial was set to begin later this month.
