Canadian artist takes on giant toymaker Mattel over trademark of her name

Who has the right to sell dolls and related merchandise in Canada using the trademark, "Caroline"? Currently, that right belongs to Victoria, B.C. artist Carollyne Yardley, but she's being challenged by multi-billion dollar toymaker Mattel, who wants to start selling its American Girl line of dolls in Canada, including one named "Caroline Abbott."...

Who has the right to sell dolls and related merchandise in Canada using the trademark, "Caroline"? Currently, that right belongs to Victoria, B.C. artist Carollyne Yardley, but she's being challenged by multi-billion dollar toymaker Mattel, who wants to start selling its American Girl line of dolls in Canada, including one named "Caroline Abbott."

Ms. Yardley sells art-related products under her "Carollyne" brand -- all featuring a signature style of using squirrel faces in paintings, which she dubs, "Squirrealism."

"I also have, under my trademark, registered for dolls, books, greeting cards and bookmarks, and that's the overlap between the two of us that is at issue," she tells Carol.
